Terms of Use
These Terms of Use (“Terms”) are an agreement between you and 2107385 Alberta Ltd. (“we”, “us”), of Grande Prairie, Alberta, Canada, covering the EveryDayBook app (the “App”) and the everydaybook.app website. The App is offered on the App Store in Canada and the United States. By downloading or using the App, you agree to these Terms.
1. Apple’s standard licence
The App is licensed to you, not sold, under Apple’s standard Licensed Application End User License Agreement (the “Standard EULA”), which applies to your use of the App. These Terms are supplemental terms that add to the Standard EULA. If these Terms and the Standard EULA conflict, including on any point Apple requires, the Standard EULA governs to the extent of the conflict. Apple isn’t responsible for the App or its content, and has no obligation to provide support for it.
2. Your book is yours
You own everything you write, file or import into EveryDayBook. We don’t claim any rights in it, and because your book is stored on your device and in your own iCloud account, we don’t have access to it. See our Privacy Policy.
3. Free features and EveryDayBook Plus
Writing your day, reading it back, searching it and exporting it are free. Some features are available through an optional auto-renewing subscription, EveryDayBook Plus (“Plus”), offered monthly or yearly.
- The price, billing period and what’s included are shown in the App before you buy. There’s no free trial.
- Payment is charged to your Apple Account when you confirm the purchase.
- Your subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in Settings → [your name] → Subscriptions. Cancelling stops future renewals; it doesn’t refund the current period, unless Apple grants a refund or the law where you live requires one.
- Plus can be shared with members of your Apple Family Sharing group, under Apple’s Family Sharing terms.
- Refunds are handled by Apple under its policies, at reportaproblem.apple.com.
- If your subscription ends, everything already in your book stays yours and you can still read, search and export it.
We may change what’s included in Plus or its price in the future. Any price change is handled through the App Store, which notifies you as Apple requires.
4. Acceptable use
Don’t use the App to break the law, to infringe anyone else’s rights, or to try to reverse-engineer, interfere with or misuse the App, except where the law allows it.
5. Not professional advice
EveryDayBook is a record-keeping tool. Reports, totals, dates and Health readings are there to help you, but they aren’t legal, tax, accounting, financial or medical advice. The Health feature shows numbers you or your devices recorded; it doesn’t diagnose or treat anything. Check anything important with a qualified professional, and talk to your doctor before making any decision about your health.
6. Keep your own backups
Your book lives on your device and in your iCloud account, which are controlled by you and Apple, not by us. We recommend exporting your book regularly. We aren’t responsible for data lost because of device loss or failure, iCloud account problems, iCloud being turned off or full, or deletion by you. Because your writing is end-to-end encrypted, if you lose access to your Apple Account and all of your trusted devices, or reset your account’s end-to-end encrypted data, Apple may not be able to recover it, and we can’t. The same applies to everything in iCloud if you turn on Advanced Data Protection and lose your recovery methods.
7. Third-party services
The App relies on services from Apple (such as iCloud, Apple Health, Calendar, Siri, Shortcuts, Mail and the App Store) and may link to outside websites. Those services are governed by their providers’ own terms, and we aren’t responsible for them.
8. Disclaimer
To the fullest extent permitted by law, the App and website are provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose. Nothing in these Terms limits rights you have under consumer-protection laws that can’t be waived.
9. Limitation of liability
To the fullest extent permitted by law, we aren’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of the App or website. Our total liability for any claim is limited to the greater of the amount you paid for Plus in the 12 months before the claim or US$50. Some places, including Quebec and some U.S. states, don’t allow some or all of these limits, so they may not apply to you. Nothing in this section limits liability that can’t legally be limited.
10. Changes and ending these Terms
We may update these Terms. If we do, we’ll post the new version here with a new effective date, and continued use of the App after that date means you accept them. If a change is significant, we’ll also tell you in the App before it takes effect. You can stop using the App at any time by deleting it.
11. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You and we agree to the courts of Alberta, unless the law where you live gives you the right to bring a claim locally. Nothing in this section takes away any protection you have under the consumer-protection laws of the place where you live.
